about the year [blank] in writing on the back of said obligation made a pretended assignment thereof assignment thereof to one & the said Smith & then fraudulently intending & continuing as aforesaid about the year 1843 caused a certain bill in to be filed in this court against the heirs administrator & widow of said Erie Rhodes (who had then departed this life) in the name of said praying for a specific performance and such proceedings now had in said cause that this court among other things decreed that one Hugh Rhod[e]s administrator of the estate of said Erie Rhods dec. then being the administrator of the estate of said Erie Rhodes dec. do execute & deliver to said and his heirs a deed of conveyance for said premises that said Hugh Rhods as such administrator by virtue of said decree did execute and deliver a deed of therefore to said and his heirs without any consideration coming from <or paid> said that as a part over penal of said transaction for the purpose aforesaid and with the fraudulent intent aforesaid the said by the procurement of said Smith & without any consideration bona fide conveyed the said premises as conveyed to him by said Rhods unto & who now hold the legal title thereto & that they now hold the same subject to the equitable right of the creditors of the said deceased to be paid out of the same [p.
